WSBC Files Class Action Lawsuit re: Gulf of Mexico Oil Spill
June 3, 2010
On May 14, 2010, Waite, Schneider, Bayless & Chesley filed a class action lawsuit in the United States District Court, Eastern District of Louisiana, in conjunction with several other law firms against BP, Transocean, Halliburton, and others. The lawsuit, Garner v. BP et al., was filed on behalf of Tom Garner, a sports fisherman who regularly fishes in the Gulf of Mexico, and all other individuals similarly situated. The lawsuit seeks injunctive relief to stop the defendants from continuing to conduct oil-related activities in the Gulf of Mexico. It also seeks economic, compensatory, and punitive damages. The lawsuit alleges violation of the Outer Continental Shelf Lands Act, negligence, punitive conduct, nuisance, trespass, strict liability, and negligence per se.
